These Terms of Service ("Terms") govern your access to and use of NovaCheck, an email validation service provided by RK Solutions LLC ("RK Solutions," "NovaCheck," "we," "us," or "our").
By creating an account, accessing NovaCheck, or using the NovaCheck API, you agree to these Terms. If you do not agree, do not use NovaCheck.
You must be at least 13 years old to use NovaCheck. If you are at least 13 but under the age of majority in your jurisdiction, you may use NovaCheck only with permission from a parent or legal guardian.
By using NovaCheck, you represent that you meet these requirements and have authority to agree to these Terms.
NovaCheck provides email validation tools, APIs, dashboards, usage tracking, and related services. Validation results are provided on a best-effort basis and should be used as one factor in your own decision-making process.
We may update, modify, suspend, or discontinue parts of the service from time to time. We may also update features, plans, limits, and pricing as the service evolves.
You are responsible for maintaining the security of your account and API keys. You are responsible for activity that occurs under your account, including API usage generated through your keys.
You agree to notify us promptly at [email protected] if you believe your account, credentials, or API keys have been compromised.
Authentication is handled by Clerk for security reasons. NovaCheck does not store your account password directly.
NovaCheck may provide API keys for accessing the service. You may not share, sell, publish, or expose API keys except as reasonably necessary for authorized use of your own applications.
You are responsible for implementing appropriate safeguards to prevent unauthorized use of your keys. We may revoke, rotate, suspend, or limit API keys if needed to protect NovaCheck, enforce these Terms, prevent abuse, or comply with law.
NovaCheck plans, features, and usage limits are described on the pricing page or in the service. Plans, features, and limits may change over time.
If you subscribe to a paid plan, you agree to pay the applicable fees. Billing is processed by Stripe. You authorize us and our payment processors to charge applicable subscription fees, taxes, and other charges associated with your selected plan.
You are responsible for keeping billing information accurate and up to date.
You may cancel your subscription as made available through the service or by contacting [email protected].
Refunds are handled manually. Refunds are typically granted for the current month of service in full when appropriate. Requests for more than one month of refunds are reviewed case by case and are generally limited to up to three months, but every case is different.
We reserve the right to approve or deny refund requests at our discretion, subject to applicable law.
You retain ownership of data you submit to NovaCheck. We do not claim ownership of submitted email addresses, API requests, customer data, or your application data.
You grant us the limited right to process submitted data as needed to provide, secure, maintain, and improve NovaCheck; enforce these Terms; prevent abuse; comply with law; and support billing and operational needs.
NovaCheck API usage records do not store submitted email addresses. To improve performance, reduce repeated validations, and help avoid unnecessary usage for customers, validation results may be stored in an encrypted cache for up to 24 hours.
You are responsible for ensuring you have the necessary rights and lawful basis to submit data to NovaCheck.

We may suspend or terminate access if we believe your use violates these Terms or creates risk for NovaCheck, our users, or third parties.
NovaCheck is provided on a best-effort basis. We strive for high availability and target 99.99% uptime, but we do not guarantee uninterrupted or error-free service unless we separately agree in writing.
Service availability may depend on third-party providers and infrastructure, including hosting, network, authentication, email, payment, DNS, CDN, and security providers such as DigitalOcean, Cloudflare, Clerk, Stripe, and SMTP2GO.
We are not responsible for outages, delays, data loss, or service interruptions caused by third-party providers, internet failures, force majeure events, maintenance, security incidents, or circumstances outside our reasonable control.
We may update these Terms from time to time. If we make material changes, we will provide notice through the service, by email, or by other reasonable means.
Your continued use of NovaCheck after updated Terms become effective means you accept the updated Terms. If you do not agree to updated Terms, you must stop using NovaCheck.
NovaCheck, including its software, branding, design, documentation, and related materials, is owned by RK Solutions LLC or its licensors and is protected by intellectual property laws.
These Terms do not transfer ownership of NovaCheck or our intellectual property to you. You may use NovaCheck only as permitted by these Terms.
If you provide feedback, suggestions, or ideas about NovaCheck, you grant us the right to use them without restriction or compensation. We are not required to treat feedback as confidential.
NovaCheck relies on third-party services to operate, including Clerk, Stripe, SMTP2GO, DigitalOcean, and Cloudflare. Your use of NovaCheck may involve or depend on these third-party services.
We are not responsible for third-party services, their acts or omissions, or their terms and policies.
NovaCheck is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that email validation results will be complete, accurate, current, or suitable for every use case. Email validation is a best-effort technical assessment and should not be treated as a guarantee that an email address is valid, deliverable, safe, or appropriate to contact.
To the maximum extent permitted by law, RK Solutions LLC and NovaCheck will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; lost data; loss of goodwill; business interruption; or costs of substitute services.
To the maximum extent permitted by law, our total liability for any claim related to NovaCheck or these Terms will not exceed the fees you paid to NovaCheck during the three months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
You agree to defend, indemnify, and hold harmless RK Solutions LLC, NovaCheck, and our owners, employees, contractors, service providers, and agents from claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising from or related to:

You may stop using NovaCheck at any time. Certain provisions of these Terms will survive termination, including payment obligations, intellectual property rights, disclaimers, limitations of liability, indemnification, dispute terms, and provisions that by their nature should survive.
Our Privacy Policy explains how we collect, use, and protect information. By using NovaCheck, you also agree to the Privacy Policy.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
Before filing a formal legal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally. We will also try to resolve disputes informally when practical.
If a dispute cannot be resolved informally, the dispute may be brought in the state or federal courts located in Wyoming, unless applicable law requires a different venue.
We may send notices through the service, by email, or by other reasonable means. You may send notices to [email protected].
These Terms are the entire agreement between you and RK Solutions LLC regarding NovaCheck. If any provision is found unenforceable, the remaining provisions will remain in effect.
You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, restructuring, sale of assets, or by operation of law.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
